Welcome to Bizarre Tropicals. These Terms of Service (“Terms”) govern your access to and use of our website, online store, and related services (collectively, the “Services”). By visiting the Services or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

These Terms work together with our Privacy Policy, Shipping policy, and Return and refund policy. If there is a conflict between these Terms and another policy about privacy or personal information, the Privacy Policy controls for that subject matter.

1. Who we are

The Services are operated by Bizarre Tropicals, a South African retailer of carnivorous plants and growing supplies. Our contact details are at the end of these Terms.

The Services are hosted on Shopify, which provides e-commerce, checkout, and related infrastructure.

2. Eligibility

You must be able to form a binding contract under applicable law to use the Services and place orders. By using the Services, you represent that the information you provide is accurate and that you are authorised to use any payment method you submit.

3. Accounts

If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorised access. We may suspend or close accounts that violate these Terms or pose a security risk.

4. Products and listings

  • We sell living carnivorous plants and related growing supplies. Descriptions, photographs, metafields (including botanical names, difficulty, and care notes), and availability are provided in good faith but may change without notice.
  • Living plants are natural products — size, colour, pitcher or trap development, and vigour may vary from photos. We do not guarantee identical appearance to catalogue images.
  • Some species or cultivars may be subject to availability, season, or regulatory restrictions (including CITES where applicable). We sell for domestic use in South Africa unless we expressly agree otherwise in writing.
  • Care information on genus pages and product pages is educational and does not guarantee growing success in your conditions. You are responsible for suitable light, water, soil, temperature, and compliance with local rules.

5. Prices, taxes, and payment

  • All prices are shown in South African Rand (ZAR) unless stated otherwise.
  • Prices, shipping charges, and promotions may change before checkout is completed. The price charged is the price shown at checkout when you submit payment.
  • Payment is processed through Shopify and approved payment providers. You authorise us and our processors to charge your selected payment method for your order total.
  • We may refuse or cancel orders (for example: stock errors, pricing mistakes, suspected fraud, or restrictions on certain products). If we cancel after payment, we will refund amounts paid for the cancelled items.

6. Orders and contract

  • Your order is an offer to purchase. A binding contract is formed when we send an order confirmation email (or otherwise confirm acceptance). We may accept part of an order and cancel unavailable items with a refund.
  • You are responsible for accurate shipping and contact details. Delays or loss caused by incorrect addresses or failure to receive the parcel may affect remedies available under our Return and refund policy.
  • We may limit quantities per customer, per order, or per household where reasonably necessary.

7. Shipping and delivery

Shipping terms, dispatch timing, packaging, and live-plant handling are described in our Shipping policy. Risk of loss for goods generally passes to you upon delivery to the address you provide, subject to applicable law and our refund policy for qualifying transit damage.

8. Returns, refunds, and cancellations

Returns, replacements, refunds, and cancellations are governed by our Return and refund policy. Living plants generally cannot be returned after dispatch due to biosecurity and plant stress; contact us promptly if there is transit damage or an fulfilment error.

9. Acceptable use

You agree not to:

  • Use the Services unlawfully or in a way that harms us, other customers, or third parties;
  • Attempt to interfere with the security or operation of the Services (including scraping, malware, or unauthorised access);
  • Misrepresent your identity or payment authority;
  • Resell or export products in breach of law or our policies without written permission.

10. Intellectual property

All content on the Services — including text, graphics, logos, photographs, and layout — is owned by Bizarre Tropicals or used under licence and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or exploit our content for commercial purposes without our prior written consent, except as allowed by law or for personal, non-commercial reference.

11. Third-party links and services

The Services may link to third-party websites or tools (for example social media). We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

12. Disclaimers

To the fullest extent permitted by South African law, the Services and all products are provided on an “as is” and “as available” basis. We disclaim warranties not required by law, including implied warranties of merchantability or fitness for a particular purpose, except where they cannot be excluded.

We do not warrant uninterrupted or error-free operation of the Services. Growing outcomes depend on your care and environment; we are not liable for plant loss after delivery except as set out in our refund policy.

13. Limitation of liability

To the extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential loss (including lost profits or data) arising from your use of the Services or products.
  • Our total liability for any claim relating to an order is limited to the amount you paid for the products giving rise to the claim, except where law requires otherwise (for example gross negligence or liability that cannot be limited).

Nothing in these Terms limits rights you may have under the South African Consumer Protection Act or other mandatory consumer laws where they apply to you.

14. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, or violation of law, except to the extent caused by our wrongful conduct.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. You agree to the exclusive jurisdiction of the South African courts, subject to any mandatory rights you have to bring proceedings in another forum under applicable consumer law.

We may update these Terms from time to time. The “Last updated” date above indicates the current version. Material changes may be communicated as required by law. Continued use of the Services after changes constitutes acceptance of the updated Terms, subject to applicable law.
